These Terms of Service ("Terms") govern your use of the website (rochestersmartai.com) and services provided by Rochester Smart AI ("we," "us," "our"), a women-owned business in Rochester Hills, Michigan.

1. Services

We provide AI receptionist services, including inbound call answering, appointment scheduling, lead capture, and related consulting. Services are provided via third-party platforms (Vapi.ai, Twilio, etc.).

2. Eligibility

You must be 18+ and capable of forming binding contracts to use our services.

3. Free Demos

Free demos are for evaluation only. No payment is required to test the AI receptionist.

4. Paid Services & Pricing

We offer monthly subscription plans for AI receptionist services:

• Starter: $149/month — 150 included minutes
• Growth: $299/month — 400 included minutes
• Business: $499/month — 800 included minutes
• Premium: $499/month — 2,000 included minutes

Additional terms:

• Setup fee: $249 one-time (waived with annual prepay or for early adopters)
• Overage: $0.45/min beyond included minutes (Premium: $0.30/min). You will be notified at 80% usage.
• Minute packs: Available as add-ons (Basic: +100 min/$45; Standard: +200 min/$79; Pro: +300 min/$129)
• All plans are month-to-month. Cancel anytime with 30 days' notice.
• Pricing subject to change with 30 days' written notice.

5. Free Trials & Promotions

• Free trial: 7-14 day trial available. No credit card required. Trial includes limited minutes for evaluation.
• Promotional discounts: First-month and annual prepay discounts may apply. See website for current offers.
• We reserve the right to modify or end promotions at any time.

6. Payment

Payments are processed via Stripe. By subscribing, you authorize recurring monthly charges. Late payments (15+ days overdue) may result in service suspension. Prorated refunds available for mid-month cancellations.

7. Opt-Out & Consent

• SMS: Reply STOP to any message to opt out of reminders and notifications
• Calls: By calling our AI receptionist number, you consent to AI-powered answering and processing of your call
• Recording: Calls may be recorded for quality and training purposes. You will be notified at the start of any recorded call

8. Fair Use Policy

Included minutes are intended for legitimate business call answering. We reserve the right to suspend accounts that abuse the service (e.g., automated load testing, call forwarding loops, or use for non-business purposes).

9. Limitation of Liability

Services are provided "as is." We are not liable for missed calls, scheduling errors, incorrect transcriptions, or business losses arising from use of our services. Maximum liability is limited to fees paid in the last 3 months.

10. Termination

Either party may terminate monthly service with 30 days' notice. We may suspend service immediately for non-payment, abuse, or violation of these terms. Upon termination, your data will be retained for 30 days, then permanently deleted upon request.

11. Intellectual Property

All content, branding, and technology on this website and in our services are owned by Rochester Smart AI. Custom AI configurations created for your business remain our intellectual property, though you retain ownership of your business data.

12. Data & Privacy

Your use of our services is also governed by our Privacy Policy.

13. Governing Law

Michigan law governs these Terms. Any disputes shall be resolved in Oakland County courts.
